OFFICIAL GENERAL SWEEPSTAKES RULES

By participating in any contest on this Site, entrants agree to the specific rules, conditions and terms provided for that particular contest as stated, either in addition to or in place of the Official General Sweepstakes Rules provided here. Additions or deletions to these rules and addendum (if any) are subject to the discretion of WIL and Koodos, and may be enacted at any time.

NO PURCHASE IS EVER NECESSARY TO ENTER OR WIN. PURCHASE OF ANY PRODUCT OR SPONSOR PRODUCT WILL NOT INCREASE YOUR ODDS OF WINNING. VOID WHERE PROHIBITED BY LAW.

Eligibility/Restrictions
Employees (and their immediate family and household members) of , WIL, Koodos LLC, SCA Promotions, and other participating sponsors, their affiliates, franchisees, promotional and advertising agencies, are not eligible to participate.    Game contest is subject to federal, state, and local laws and regulations.  You must be thirteen (13) years or older to win prizes. All aspects of the game, including scheduling and the awarding of prizes, are subject to Acts of God, force majeure, and any other acts or conditions beyond the express control of the sponsors of this website.  Acceptance of any prizes awarded constitutes permission to use the winner's name and likeness for promotion, advertising and publicity purposes at no additional compensation, except where prohibited. The winners, by entering the sweepstakes and accepting the prize, agree to release all sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, licensees, franchisees, suppliers, distributors, and advertising agencies from all liability, claims, or actions whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the contest, the receipt, ownership, use or misuse of the prize, and while preparing for, participating in and/or traveling to or from any prize related activity.

Prizes Awarded
Identification of sweepstakes winners will be determined by Koodos, whose judgment is final.  Sweepstakes winner(s) will be chosen at random from all qualified and eligible entrants. Prize winners will be contacted by email using the email address used in their registration process.  No other notification will be given.  If we are unable to locate the winner based on the information provided on the entry form, an alternate winner may be selected from all other eligible entries. If the prize is valued at $600.00 or more, winners are ineligible to win another prize for ninety (90) days; if the prize is valued under $600.00, they are ineligible for thirty (30) days. All federal, state, and local taxes, are the sole responsibility of the winner. An IRS form #1099 will be issued by WIL for all prizes valued at $600 or more. WIL is responsible for the notification of winners and fulfillment of any and all WIL themed prizes.  All prizes, unless otherwise specified, must be picked up at WIL within thirty (30) working days. Winners will not be notified of the time remaining to claim their prize. All major prize winners must show driver’s license or other form of picture ID to claim prize and may be required to sign and return an affidavit of eligibility and release of liability form within seven (7) days of notification or attempted notification. The prizes are not transferable and no substitution of prizes or cash redemption of prizes is permissible, except by a sponsor who may substitute a prize of equal or greater value if featured prize is unavailable. Winner agrees to the use of his or her name and likeness to be used in association with receipt of prize, or prize will be forfeited and may be awarded to an alternate winner.  For a complete list of major prize winners, send a self-addressed stamped envelope to Koodos Winners List, 120 East Market, Suite 450, Indianapolis, IN 46204. 

Entry
All entries become the property of WIL and Koodos and will not be returned to entrant. Post card entries must be complete, legible, and submitted by the account holder whose screen name and email address is provided to be eligible for entry. Any prize awarded will be awarded to the authorized account holder of the email account associated with the Koodos membership. Automated entries (including but not limited to entries made using any script, macro, bot, mechanical means or sweepstakes service) will not be accepted, and will be disqualified. WIL and Koodos are not responsible for incomplete, illegible, or lost post card entries.

In the event of a dispute regarding who submitted an entry via e-mail, the entry will be deemed submitted by the authorized account holder of the e-mail account.

Users may only play the Games with one type, version or copy of browsing software application at any one time. The use of machines, computers, scripts or any automated system to play the Games ("Automated Cheats") is strictly prohibited and may result in criminal liability under the Computer Fraud and Abuse Act, Section 1030 of the United States Code. The accumulation of Koodos generated through Automated Cheats is also strictly prohibited, regardless of whether the Automated Cheat was used in connection with your account. Koodos's determination of whether an Account is accumulating Koodos generated through Automated Cheats is in Koodos' sole discretion.

Koodos  may be accrued on Koodos' site according to these rules and other posted rules related to particular games. Koodos has the right to immediately terminate a player's account and permanently disqualify the player from access to games if Koodos determines that the player has bought or sold or otherwise acquired Koodos for use on our site for any purpose.

Koodos may terminate and permanently disqualify any entrants in any prize drawing or other activity on this site who Koodos, in its sole discretion, determines as being in violation of these Official General Sweepstakes Rules. If Koodos terminates a player's Koodos Account and/or disqualifies a player from the play of any game(s), the player will immediately lose any right of access to any Koodos, associated with his or her account. All decisions by Koodos are final.

In order to discourage and deter misconduct in connection with game play and drawings, Koodos may place limits on the total number of Koodos players can earn in a given time period or use in an individual sweepstake.

WIL, Koodos, and affiliated companies, agents, and representatives are not responsible for error, omission, interruption, deletion, defect, or delay in operations or transmission; theft or destruction or unauthorized access or alterations of entry materials, computer transmissions, or for technical telephone equipment, electronic, hardware or software, network, Internet, or computer malfunctions of any kind; or inaccurate transmission of, or failure to receive entry information by Koodos on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof.

WIL, Koodos, and affiliated companies, agents, and representatives are not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed software transmissions which may limit a participant's ability to participate, or damage user's system as a result of participation, or downloading any information necessary to participate in the Games.

If technical difficulties compromise the integrity or ability to continue online registration or play, Koodos reserves the right to terminate the Games prior to the stated date by which all registrations must be received.

By participating in the Games, the entrants agree to be bound by these Rules. These Rules will be interpreted in Koodos' sole discretion, and all determinations made pursuant to these rules by Koodos are final and binding.

WIL, Koodos, and affiliated companies, agents, and representatives are not responsible for: (i) Any condition caused by events beyond their control that may cause the Games, the entry process, or the website to be disrupted or corrupted; (ii) Any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of any prize, or acceptance, possession, or use or misuse of any prize, or from participation in the Games; (iii) Any printing or typographical errors in any materials associated with the Games or the entry process. Koodos reserves the right, in its sole discretion, to suspend or cancel games in whole or in part, in the event of technical or other difficulties.

By participating in the games, each participant agrees to release and hold , WIL, Koodos, its parent, subsidiaries and affiliated companies, and the employees, officers, directors, shareholders, agents, representatives, its parent, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the games, the entry process, or resulting from acceptance, possession, or use or misuse of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.

All entries become the exclusive property of WIL and Koodos, and as such, they have the right to edit, adapt, modify, publish, promote and otherwise use or not use the entries and the information contained therein in any way they see fit. Entries will not be returned.

Limitations of Liability
By entering the Sweepstakes, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action, and entrant waives his or her right to a jury trial for such disputes, claims, and causes of action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

Construction
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official General Sweepstakes Rules, or the rights and obligations of any contestant and WIL and Koodos, shall be governed by, and construed in accordance with the laws of the State of Indiana, without giving effect to any choice of law or conflict of law rules or provisions (whether of Indiana, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Indiana. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. WIL and Koodos’ decisions regarding the selection of winners and all other aspects of the Sweepstakes shall be final and binding in all respects. WIL and Koodos will not be responsible for typographical, printing or other inadvertent errors in these Official General Sweepstakes Rules or in other materials relating to the sweepstakes.

General Release
By entering the Sweepstakes, contestants release WIL, Koodos and any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Sweepstakes or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).

Odds of Winning
Odds of winning any of the sweepstakes depend solely upon the number of qualified entries received for the sweepstakes entered. Sweepstakes are made available on a national basis and may be run on several websites across the country, including multiple websites in your city. In the event that a prize is being offered only in your city or on this individual website, the specific rules of the sweepstakes will include this information.
